Skin Cancer Medical Malpractice Suit Gets $6 Million Verdict

A California man who alleged his doctor failed to diagnose skin cancer received a $5.7 million verdict in a medical malpractice lawsuit against the physician. Due to California’s cap on damages, the verdict was reduced to $1.9 million.

Regis M. Reilly, 53, claimed dermatologist Dr. James C. Powers failed to biopsy a cyst that later metastasized into cancer. Reilly has a family history of skin cancer.

The award included $3 million in general damages for Reilly’s wife to compensate for the negative impact on the couple’s marriage. Reilly won another $1.6 million for his own mental pain and suffering and $1.1 million for lost income.

Prior to being reduced due to malpractice award caps, the verdict was the largest in the state this year.
